An Empirical Look at the Industry

In 2016, the New Yorker pegged the litigation funding market as a $3 billion dollar asset class, and other figures similarly suggest that litigation finance is moving into the mainstream. In fact, the percentage of U.S. lawyers who say their firm used litigation finance grew from 7 percent in 2013 to 11 percent in 2014, and then to 28 percent in 2015, according to a report from legal financing firm Burford Capital.

Although few empirical studies of third party litigation funding have been commissioned so far, all existing evidence points to the rising use of litigation finance by law firms around the United States. As the industry comes of age, Legalist is focused on helping smaller law firms who may not have the opportunity to work with other litigation funders take advantage of this unique opportunity.
