Confronting the Unexpected

Welcome to the digital interactive version of the program presented at the Forum's Annual Meeting held April 24-26, 2008 in La Quinta, CA. If you are viewing this on a CD, you will be able to access all of the papers presented at the program, as well as the appendices and the complete slide presentations used by the speakers. Also included is an electronic construction law library index. If you have an internet connection, you can use the CD to link to the Web Site created in connection with the program. The Web Site is interactive (the papers contain HTML citations) and can literally link you to the speakers, their firms and the Forum. Practitioners will find particularly helpful the elibrary, with links to numerous free sites where you can obtain cases, statutes, articles and more related to construction law. Lastly, there are links to a number of other free Web Sites you will find useful and informative.

In a best case scenario, clients are prepared through good contracts, appropriate insurance, risk management and other preventive measures to avoid or manage problems before they develop. Unexpected problems can arise, however, despite the best advance planning. As our program title suggests, clients dealing with immediate adversity often need and expect prompt legal assistance to manage and overcome their pressing troubles, and are loathe to hear admonitions on how they could have better handled or prevented their crisis, or even how to avoid such problems in the future.

Managing risk and adversity through careful contract drafting and management has been the subject of prior programs. This program, "Don't Tell Me What I Should Have Done ­ What Do I Do Now? Confronting the Unexpected" addresses advanced strategies for dealing with often unanticipated problems arising during the construction process and beyond. Experienced and knowledgeable speakers from across the country will discuss practical tips and mechanisms, drawn from personal experience, for dealing with a variety of challenges that may arise during the construction process. Attendees will receive materials to help them provide timely and informed counsel and to prepare quick and confident responses to meet clients' needs.
